Why Use Commercial Mediation?

If you're heading for court due to a legal dispute, mediation offers a faster, more cost-effective solution.

  • Uncertain outcomes and rising legal costs can feel like a gamble.
  • Court cases can take over a year, draining resources and control.
  • Often, legal fees exceed the value of the dispute.

Through mediation, you can resolve disputes more affordably and confidentially, allowing you to get back to business quickly.

The Risks of Litigation

Choosing litigation means facing inevitable risks, costs, and delays:

  • It distracts from your core business.
  • Cross-examination in court can damage reputations.
  • Courts may refuse to award costs to a winning party if mediation was declined.

Mediation offers a confidential, cost-effective, quick, and binding resolution in over 90% of cases, often in just one day.

How Commercial Mediation Works

Our mediators are experts in conflict resolution, not just law, ensuring effective solutions tailored to your case. Here’s what to expect:

  • Separate rooms for each party with the mediator facilitating between both sides.
  • Optional open session to state your case, but this is not compulsory.
  • Confidentiality is key—the mediator only shares information you approve.

The focus remains on settlement, with or without lawyers present. Ensure the decision-maker is available to finalise any agreements on the day.

Business Disputes

Business disputes can paralyse companies, draining time and money. Mediation helps you restore balance:

  • Swift resolutions with minimal disruption.
  • Mediations can be arranged within a week.

In over 90% of cases, disputes are settled in just one day.

FAQ

What is mediation?
Mediation is a confidential process where an impartial third party (the mediator) helps resolve disputes. It’s a voluntary process—all parties must agree to participate.

Can mediation help me?
Mediation can address any dispute if all parties agree to participate. It’s often quicker and less expensive than litigation, suitable for business, personal, family, and probate disputes.

How does mediation work?
Mediation is tailored to the dispute:

  • Initial consultation: Confirm willingness, explain the process and costs.
  • Scheduling: Agree on date, time, and venue; send confirmation and invoice.
  • Preparation: Submit summary/position statements and relevant paperwork (optional).
  • Process: Mediation usually occurs in separate rooms, with the mediator facilitating communication.
  • Outcome: Agree on a summary of the outcome, which is signed by all parties.

What if no agreement is reached?
Most mediations are successful, but if no agreement is reached, nothing discussed can be used later in court without both parties' consent. The mediator cannot be called as a witness.

How long will the mediation take?
Most mediations are resolved within a single working day, sometimes even within a few hours.

What does mediation cost?
Fees are generally based on the claim value. Refer to our cost schedule for details. Any venue or refreshment costs are usually shared equally between the parties.
